The Occupational Safety and Health Administration (OSHA) released an emergency temporary standard (ETS) earlier this month requiring private employers with 100 or more employees to require COVID-19 vaccination or weekly testing and masking for their unvaccinated employees. The ETS requires covered employers to ensure all unvaccinated employees working in person begin wearing masks by Dec. 6, 2021, and provide a negative COVID-19 test on a weekly basis beginning Jan. 4, 2022.

While many lawsuits have been filed challenging the ETS throughout the country, White House spokesperson Jen Psaki has repeatedly directed employers to continue operating on the assumption that the ETS will survive and that we are still heading towards the same timeline. Assuming the ETS is upheld, after Jan. 4 employers could face significant consequences for not having met the requirements.

Some of these improvements include enhanced group messaging, customizations for testing oversight of employees with irregular schedules, and telehealth to allow centralized employer proctoring of antigen testing.
